But, just for fun! - my guess is that she's going to trim out some issues from the lawsuit (ie. the "staking" allegations which always seemed farfetched to me) and leave the other issues to move forward into discovery. A partial victory for Coinbase.

The SEC then tries to distinguish Beanie Babies, and for the most part fails because the truth is that, for the SEC, a Beanie Baby IS a security.


The common thread is that he is arguing they are both examples of executive branch agencies exercising power in the absence of a clear grant of that power from Congress on the grounds that the text of the law is ambiguous and so they should get to choose what it means.
