Are you saying that it is arguable that the Bitnominal futures contract for XRP is a security futures contract even though XRP itself is not a security because there is no ruling yet in any case on whether secondary market sales are investment contracts.

Though, as you know, the Ripple court expressly held it was not addressing secondary sales of XRP, which are at issue here. Doesn't mean it's not shaky ground for the SEC (like the other exchange cases). But as you're good about reminding us, the SJ order is limited to its facts.
