#XRPCommunity #SECGov v. #Ripple #XRP BREAKING: SEC Files Letter outlining its basis for filing a Motion for Leave to File an Interlocutory Appeal regarding “Programmatic” offers and sales to XRP buyers over trading platforms and Ripple’s “Other Distributions.”…

AND... the SEC continues making questionable decisions, requesting an interlocutory appeal.
— Jeremy Hogan (@attorneyjeremy1) August 9, 2023
Note that it is NOT appealing whether XRP itself is a security - just its losses on the programmatic and individual sales issues. https://t.co/GziVLp23mT
The SEC seeking a stay of all proceedings pending appeal is not unexpected.https://t.co/QxQc8ZoG63

The SEC does not have the “right” to appeal just yet which is why they are asking permission to file an “interlocutory” appeal. Ripple will file its response with the Court next week. Stay tuned. https://t.co/zCeVZhYfxc

#FactCheck on pre-trial schedule issued today by Judge Torres (1/2)
— CryptoLaw (@CryptoLawUS) August 9, 2023
- @Ripple is NOT "going on trial"
- Judge Torres' ruling that the XRP token is not a security is NOT going to trial
- The trial will NOT decide matters of law, only one narrow set of facts in dispute
The individual Defendant's trial will begin around May 2024. That means Final Judgment in this case won't be entered until...late summer 2024 (at earliest). Any appeal would go well into 2025.

The glove is on the other hand now,
delays are GOOD for XRP and Ripple. #legalclarity https://t.co/C1VMrU6Wm1
The case between the SEC and Ripple is over. (It is the case against the individuals which is going to trial.). The only thing left for Ripple is the remedy for their $700m in unregistered securities sales, which could be settled or decided by the court.

For one year I called out the Hinman conflicts and, although I said there was a gross appearance of impropriety (which technically violates 18 USC 208), I never accused him of a crime during that first 18 months.

☠️ “Deth Code” ☠️

Looks like #PayPal can freeze your wallet that holds their coins and even burn them if they want to
This type of action as been referred to as the “deth code” 🚩

Crypto critic/x-SEC official @johnreedstark says there should be an investigation into Bill Hinman. This is broader than Ripple - there could potentially be serious conflicts of interest by a gov official. An investigation will either put it to rest or hold folks accountable. pic.twitter.com/keXdigT5aa

But that being said, if the SEC is going to file an interlocutory appeal, I would expect it to be filed this week. 👀 pic.twitter.com/4J9UUVptUM

Reminder that Jay Clayton did indeed apologize to Brad Garlinghouse for the lawsuit against Ripple and XRP through celebrity Kevin Sorbo.

1/12 I attended @consensus2024, a leading #crypto conference this year. A couple of IRS guys unexpectedly swung by my booth. One of them had a role in issuing guidance, and though I wasn't there when he first stopped by, my staff encouraged a second visit.

Maxine Waters is “deeply concerned” that PayPal chose the NYDFS path versus the Federal path…Federal path for issuing a stablecoin literally doesn’t exist. What planet are we on? https://t.co/bhNfGLow4S
— Matt Walsh (@MattWalshInBos) August 9, 2023
No, it isn’t exactly the same thing. Her finding on the XRP token itself not being a security was dicta. She then did a strict Howey analysis of the sales the SEC itself named in the complaint. Her Howey analysis of the Programmatic and Other sales are essentially what they are…

Return of the XRP - SEC WARS
Epic Fail Hall of Fame inducted Gary and the SEC on July 13, 2023. Their XRP-as-security claim collapsed while XRP coolly moonwalked into the sunset, sporting its sparkling legal clarity like a new pair of Ray-Bans.
